Legal Separation is a legal process by which a married couple may undergo a de facto separation while remaining legally married. A separation allows you to live apart, without divorcing or ending a civil partnership.

    What is Legal Separation?

A separation is granted in the form of a court order, which if properly obtained forms a legally-binding consent decree. You can ask for a legal separation for the same reasons you could file for a divorce, However, you don’t need to show that the marriage has broken down irretrievably. These reasons include:

    • Adultery
    • Unreasonable behaviour

    Why get a Legal Separation?

You may want a separation if:

    • You have religious reasons against divorce
    • You’ve been married less than a year
    • You want time and space to work out if you want to end the marriage

The most common reason for filing for separation is to make interim financial arrangements, such as deciding who will pay bills, possess property or if maintenance is needed.
